Trooper Likely Won't Face Charges In Fatal Crash

WESTMINSTER, Md. (AP) ― The Frederick County prosecutor handling the case of a state trooper who hit and killed a Finksburg man says the trooper likely won't face any charges.

Frederick County prosecutor Kirsten Brown says a decision was made in May not to charge trooper Dale Derr in the death of 38-year-old Randy Rakes.

Brown says there wasn't enough information to prove that Derr's speed caused the crash. She says she wrote state police notifying them that charges wouldn't be filed.

Frederick County reviewed the case because the Carroll County State's Attorney's Office doesn't handle cases involving Carroll law enforcement officers.

David Ellin, a lawyer for Rakes' family, says he was never notified that charges would not be filed.

State police did not respond to calls from the Carroll County Times about the case.
