Court Of Appeals Denies Stay On Clerk's Deposition
ANNAPOLIS, Md. (AP) ―
The Court of Appeals Monday denied a request to block the deposition of a key figure in a Republican-led legal case seeking to nullify last month's special session.
That means Mary Monahan, who is the chief clerk of the Maryland House of Delegates, will have to go through with the deposition either Wednesday or Thursday.
The attorney general's office argued that Monahan should not have to take part in the deposition, saying her comments couldn't be germane to the legislative process.
Attorneys representing Republicans say the Senate violated the constitution by adjourning too long without permission from the House.
They want to question Monahan, who records House proceedings, about records kept during the session.
The session resulted in more than $1.3 billion in tax increases, many of which go into effect this week.
