Md. Appeals Court Orders Retrial Over New DNA Test
ANNAPOLIS, Md. (AP) ―
The Maryland Court of Appeals has ordered a new trial for a Gaithersburg man convicted of murder 14 years ago.
Jermaine Deeric Arrington, 34, was convicted of second-degree murder in the 1994 stabbing death of Paul Simmons, 19.
The appeals court ordered the new trial Tuesday because DNA testing done after Arrington's conviction showed that blood on his sweat pants didn't come from Simmons.
During the trial, a police expert testified that the blood on his pants was the same blood type as Simmons.
Arrington was convicted of stabbing Simmons during a fight at a birthday party. Simmons' mother had been Arrington's school principal and one-time mentor.
