Judge Postpones GOP Lawsuit Over Special Session

WESTMINSTER, Md. (AP) ― A Carroll County judge has postponed proceedings in a lawsuit seeking to overturn taxes approved in last month's special session after an attorney said the chief clerk in the House of Delegates is avoiding a deposition.

Circuit Court Judge Thomas Stansfield has postponed the case until January 4. Stansfield says Mary Monahan's deposition could have great bearing on the case.

Attorney Irwin Kramer told the judge that Monahan is "a fugitive from justice," because she has avoided being deposed.

Assistant Attorney General Austin Schlick told the judge that Monahan's deposition is irrelevant and immaterial to the legislative process.

Republicans are arguing that the Senate wrongly adjourned for more than three days without permission from the House, violating the state's constitution.
