Constellation, Residents Reach Fly Ash Deal
BALTIMORE (AP) ―
Constellation Energy and Gambrills residents have reached an agreement in a suit filed over coal ash contamination in Anne Arundel County.
TheĀ settlement, announced Friday evening, provides for the connection of 84 households to public water.
It also calls for the establishment of two trust funds to compensate affected property owners. The settlement is estimated to cost $45 million.
Hassan Murphy, whose law firm represented the residents, said his firm believes this is the first settlement with a major public utility over the proper handling and treatment of fly ash.
The Gambrills residents had filed the class-action lawsuit in November 2007.
Fly ash is residue that is left after coal is burned.
Constellation dumped 3.8 million tons of fly ash at the Gambrills site between 1995 and 2006, according to a Department of Natural Resources study released in June.
The settlement also calls for the restoration of the quarry, and the commitment to end deliveries of coal ash to the quarry.
Constellation could not be reached for comment.
The agreement must be approved by the Baltimore City Circuit Court.
