Man Gets 40 Years For Kidnapping & Sex Assault

TOWSON, Md. (WJZ) ― A 19-year-old man will spend 40 years in prison for his role in the armed kidnapping and robbery of two teenagers at a light rail station and the subsequent sexual assault of one of the victims. 

Andrea Fujii reports Brian Scott learned his fate Tuesday morning in Baltimore County Circuit Court, and he was not happy.

Prosecutors accused Scott and an accomplice of abducting the couple -- both 17 at the time of the October 2008 incident -- as they sat in a car in a Timonium light rail station parking lot.

The two men approached the vehicle with guns and demanded that the teens open a door. The boy was forced into the trunk and the girl was made to undress in the back seat.

The two men drove around for two hours, during which time the young woman was raped.  They then left both victims in Cherry Hill.

Scott, who was 18 at the time of the incident, was sentenced to 60 years with 20 suspended.

In court Tuesday, Scott first apologized for his crimes. But when the judge read his sentence, he burst out in anger, swearing and saying, "This is nuts." 

"Maybe he thought he could sweet talk the judge and get something better, but it obviously didn't work." said Scott Shellenberger, Baltimore County State's Attorney.

The victims are now in college and weren't at the sentencing, but the state's attorney says they're still traumatized.

"They had written to the judge a letter of which he had read before. We're a year out and they're still healing, but they are doing better," said Shellenberger. 

Scott's accomplice, Kiheem Malik Taylor, 23, was sentenced separately Aug. 28 and ordered to spend the rest of his life in prison with two consecutive life terms.

In court Tuesday the judge said that Scott's sentence was better than he deserved.  Scott struck a plea deal when he helped police catch Taylor. That shortened a possibly longer sentence.

"This defendant is what I like to say is less bad than the other defendant. But not for Scott telling us who the rapist was, there would be a rapist running loose," said Shellenberger. "My job is to make sure that Taylor and Scott don't do this again, and they're going to be in jail for a very long time."

Scott's attorney says Scott never had a father figure and that led him to Taylor, who is believed to be the mastermind behind the crime.
