State & Constellation In Negotiations Over Lawsuit

ANNAPOLIS, Md. (AP) ―

Constellation Energy and Governor Martin O'Malley's administration are negotiating in a lawsuit over $386 million in energy credits.

O'Malley spokesman Rick Abbruzzese says the state and Constellation have been in negotiations for about a week.

Constellation spokesman Rob Gould confirms discussions are taking place, but he declined to comment in detail on the talks, which were first reported by WBAL-AM in Baltimore.

Constellation filed a lawsuit earlier this month in federal court. The Baltimore-based company wants to end credits to customers that were approved in a June 2006 special session to address rising energy costs at subsidiary BGE.

The state filed a lawsuit days earlier in Baltimore Circuit Court to maintain the credits.
