Transcript From Castillo Hearing
ROCKVILLE, Md. (WJZ) ―
This is a partial transcript of a January 2007 Montgomery County Circuit Court hearing, where Amy Castillo tried to get a permanent protective order against her estranged husband Mark Castillo.
Amy Castillo Testimony:
"Mark told me, 'What does it matter anymore?'"
"He told me he could make it difficult for me after I had the children."
"He said he could sabotage the house if he wanted to."
"He has broken a lot of my artwork and furniture and glass in the past."
"He told me what could be worse is if he killed all of us, and then he said actually worse than that, if he killed the children and not me so that I would have to live without them."
"I see him being more upset and frustrated and angry and saying, 'What does it matter anymore.' So that's why it really concerns me."
Vanessa Atterbeary--Prosecution, Amy's Attorney: "He threatened to kill possibly you and the children on December 23rd?" Amy Castillo: "Yes."
Vanessa Atterbeary--Prosecution, Amy's Attorney: "Did you call the police?" Amy: "Yes. They said because he has no known address they cannot help me."
Vanessa Atterbeary--Prosecution, Amy's Attorney: "Do you feel safe in your home." Amy Castillo: "No." Vanessa Atterbeary--Prosecution, Amy's Attorney: "Are you still residing there?" Amy Castillo: "No, I am not. The locks are broken out. The window's broken out. The deadbolt's been broken, and so I don't feel safe living in the house because of the conflict we're having."
Vanessa Atterbeary--Prosecution, Amy's Attorney: "Are you fearful today that he may at some point harm you and the children?" Amy Castillo: "Yes."
Vanessa Atterbeary--Prosecution, Amy's Attorney: "Are you worried for the physical safety of your children?" Amy Castillo: "Yes."
"He called me and said he had taken Austin out of his bed, and he wouldn't tell me where he was staying that evening, and I could not call him on the phone because he wouldn't answer."
The children's nanny refused to come to their home.
"She is scared of the situation. She does not want to be alone with Mark."
"He said he was looking on the Internet for where to stick the knife to kill himself."
"I called the police. I went to the court, and nobody would help me with this situation."
"Police told me this is a custody matter, and they're not interested."
"I'm not going to wait until they get hurt to take them away."
Douglas Cohn--Defense Attorney, Mark's Attorney: "He threatened to kill your children and you, and you made love to him that night." Amy Castillo: "Yes, because I'm scared of him."
"If I act scared or upset or emotional, he really reacts to that, and I didn't want him to know I was trying to get a protective order."

Mark Castillo's Testimony
Mark Castillo: "We have three beautiful children."
"I do want to get help, and I do want to see my kids."
"I got very angry. I got tired of being slammed with seeking counseling,and I just wanted a break."
"I wanted to help myself deal with my wife, who was able to get me very angry. With these protective orders as well, I got more angry."
On killing the kids: "I've never made any comments like that of the children."
Judge: "Did you say,'If I lose my kids, I could kill myself. I could kill us all?" Mark Castillo: "Never, Your Honor."
"My understanding is she's making the whole day up."
"She's upset because I don't want to work on the marriage."

Judge's Ruling--Judge Joseph Dugan
"There is not clear and convincing evidence that the alleged acts of abuse occurred."
"I am concerned about the three children in this case, and I am concerned about the situation that they are in."
