Dismissal Motion Weighed In Juvenile Death Case

WESTMINSTER, Md. (AP) ― A Carroll County judge is considering a motion to dismiss a reckless endangerment charge brought against six counselors after last January's death of a Baltimore teenager at a private reform school.

Defense attorneys claim the charge is invalid because a grand jury declined to indict the counselors on the related charge of manslaughter. Circuit Judge Michael Galloway said he would issue a written decision on the motion.

The counselors are accused of waiting 41 minutes to call 911 after 17-year-old Isaiah Simmons became unresponsive while being restrained by staff at the now closed Bowling Brook Preparatory School.

Court records say another motions hearing is scheduled for Jan. 25.
